Introduction

This site has the purpose to create the principles of a constitution for the European Union from the people of the EU, instead of the version merchandised by politicians and transnational companies.
We want to combine the best for the people from the existing national constitutions, instead of taking only the common parts for the benefit of the industry. Certainly, a working trade and industry is necessary, but the economy has to be measured at it's benefit for all people, not the people at their benefit for the economy.

To get the best from all national constitutions, everyone is invited to add the best principles from her or his constitution to this site, to create a European Union of values, not only a huge market place.

English was chosen as language of this site to permit the highest account of Europeans to join this development. Permanently synchronizing versions in all, or at least 3, european languages overcharges our resources.
But don't hesitate writing imperfect english, the author of this text isn't native english either (I'm sure every native speaker recognizes it). It's only important, that everyone understands what you mean, and perhaps someone else will correct the grammar.

In commemoration of the horrible wars that marked Europe, we, the People of Europe, come together in order to create a democratic union of our nations and a constitution thereof. We found this union and its constitution on the ideals of freedom, equality and brotherliness, on justice, faith and care for our posterity, on the welfare of the citizens, our friendship to other peoples, the need for self defense and on both domestic and global tranquility.

Principles for a future-save european constitution


Definition of the European Union

  • We the Peoples, in order to form a more perfect union, establish justice, secure the blessings of liberty and solidarity to ourselves and our posterity, promote the general welfare, provide for the common defence and insure domestic tranquility, do ordain and establish this constitution for the European Union. (from U.S. Constitution, amended)
  • The European Union is an ecological and social Democracy. It acts in a balance between social justice and successful economy with the target of an ecologically sustainable development.
  • The values of the European Union are based on the humanistic principles of the French revolution of freedom, equality and fraternity, as well as the substantial values of faith, declared in the [world ethic].
  • The EU builds a region of solidarity and mutual help between it's members.
  • The EU represents a Europe of the Regions.
    • It provides a domestic market without frontiers, but with fundamental priority for local circulations. (To be realized for example with a graduated value-added tax, depending on the distance of production - same region, country, EU, Europe, rest of the world.)
    • The base of all decisions is the region and the people living in it. Problems with more far-reaching significance are passed to the next higher parliament. (Subsidiarity)
  • The institutions of the EU have to respect strictly the separation of powers.
  • The European Union has the right to regulate the market for providing a fair competition and supporting it's ecological and social values.
    • Should the EU have the right or should it have to regulate the market?
  • The EU supports and enforces the diversity of suppliers in all sectors of economy and prevents monopolization.
  • In awareness of the interdependence of the nations of the world, the European Union supports the development of democratic, social, ecologic and peaceful civil societies worldwide.
  • In order to further democratic participation and justice, the legislative of the EU must keep laws and lawmaking as simple as possible. (Simplicity)
    • Laws shouldnt confuse the people, they should clarify things. The fact that we, the People, have to write the constitution from scratch that they failed to make simple and short enough proves this articles necessity. However, this is a tough one. How simple is 'as simple as possible'? How do you measure it? As this is a constitution, it is actually possible to stick with that single sentence and leave the rest to the courts; true monster laws with hundreds of exceptions that nobody bothers to read anymore may (or may not) be declared unconstitutional this way.

Constitutional rights

  • The dignity of human beings is inviolable. To protect it is the task of all institutions. (from German constitution)
  • The principle equality of all people in the world is respected.
  • The declaration of human rights is binding for all members of the EU.
  • Direct democracy is established for all important decisions.
  • The members of the EU guarantee a high level of social security to their people, which may be tailored depending on the economic power of the state.
  • Every cutomer has the right of information about the ecological and social circumstances of the manufacturing of products.
  • To force the social and ecological development worldwide, the European Union has the right to tax all external products not complying the social or ecological standards of the Union.
  • Information has to be free for all humanity. To encourage innovations, patents can be guaranteed for a limited time.
  • Every citizen of the EU has the right of education.
  • The citizens have the right of transparency of the EU-institutions.
  • The citizens have the right of healthy and not dangerous food.
     * The citizens have the right to get proper healthcare. 
  • The citizens have the right of privacy.
  • Every citizen has the right of resistance against anyone who threatens the peaceful democratic and social order, provided that no other solution is possible. (from German constitution)
  • The citizens may chose and exercise their individual or collective faith.

Constitutional duties

  • The members of the EU commit themselves of using military actions only if all peaceful and diplomatic endeavours failed.
  • Offensive Warfare is banned. (from German constitution)
  • Property and information obligate. They should be used for the benefit of all people. (property obliges from German constitution)
  • Every form of corruption is prohibited and has to be punished severe. (from Greek constitution)
  • The members of the EU commit themselves of considering the interests of their neighbours (other members of the EU) when developing national laws. (principle of open states)
  • All EU-institutions have the duty of tranparency.
  • Freedom and indepence of the press are guaranteed.
